Terms of Service for Free Gutter System Promotion

Effective Date: November 1st 2024

These Terms of Service (the "Terms") govern the promotional offer (the "Offer") provided by alteredFLIP (the "Company"). By participating in this Offer, the homeowner ("Customer") agrees to these Terms in addition to any applicable contractual terms for the purchase of James Hardie siding installation.

1. Offer Details

• Eligibility: Customers who purchase a complete James Hardie siding installation from alteredFLIP are eligible to receive up to 150 linear feet of gutter systems at no additional cost.
• Inclusions: The gutter system includes standard aluminum gutters and downspouts in a color selected from the Company’s standard color options.
• Exclusions: Specialty gutter materials (e.g., copper or premium finishes), gutter guards, or custom designs are not included in this Offer but may be purchased at an additional cost.
• Value Cap: The maximum value of the free gutter system is limited to 150 linear feet. Any gutter length exceeding this cap will be charged at the Company's standard rates.

2. Conditions of Offer

• Purchase Requirement: This Offer applies only to homeowners who complete a James Hardie siding installation contract with alteredFLIP.
• Property Eligibility: The Offer is valid for residential properties only and is subject to an on-site evaluation to confirm suitability for gutter installation.
• Non-Transferable: The Offer is non-transferable and cannot be redeemed for cash or any other product or service.

3. Scheduling and Installation

• Installation Timing: Gutter installation will be scheduled upon completion of the James Hardie siding installation.
• Access and Preparation: The Customer must ensure safe and clear access to the property for the gutter installation team.

4. Limitations and Exclusions

• Geographic Limitations: This Offer is valid only for properties located in Jacksonville, Tallahassee, Miami, and Gainesville, Florida.
• Weather Delays: alteredFLIP is not responsible for delays caused by weather or other unforeseen circumstances.
• Damage Liability: alteredFLIP is not liable for pre-existing damage to the Customer's property.

5. Modification or Termination of Offer

alteredFLIP reserves the right to modify or terminate this Offer at any time without prior notice. Any modification or termination will not affect Customers who have already entered into a contract for siding installation under this Offer.

6. Dispute Resolution

Any disputes arising from this Offer will be governed by the laws of the State of Florida and resolved through binding arbitration as outlined in the Customer’s James Hardie siding installation contract.

7. Acceptance of Terms

By entering a siding installation contract with alteredFLIP and participating in this Offer, the Customer acknowledges and agrees to these Terms.
